Vigil

1. Agreement

By installing or using Vigil ("the App"), you agree to these terms. If you do not agree, do not use the App.

2. What Vigil is — and is not

Not a medical device

Vigil is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. It does not monitor any medical condition. The figures it displays are estimates derived from consumer sensors and are not of clinical accuracy.

Vigil reports deviation from your own baseline, not an absolute physiological measurement.

Do not use Vigil as the basis for any clinical decision, any operational decision, or any decision about your own or another person's medical care. If you have a medical concern, consult a qualified clinician.

Do not use Vigil to determine fitness for duty — yours or anyone else's.

3. Limits you must understand before relying on it

The App will miss things. It is deliberately tuned to be conservative and will not detect every episode of physiological activation. The absence of an alert means nothing. It does not mean you are calm, safe, rested, or fit to proceed.
The App will sometimes be wrong. An alert means a statistical threshold was crossed. It is not a statement about your mental state, your competence, or your capacity to continue.
The detection thresholds have not been clinically validated. They are reasoned defaults derived from published physiology, not figures established by a study of this app.
Optical heart-rate sensors are imperfect, particularly during motion, in cold conditions, with tattoos, and with certain skin tones. Data may be absent, delayed, or wrong.
The App requires a functioning Apple Watch, sufficient battery, granted Health permissions, and adequate skin contact. If any of these fail, the App is not monitoring — and may not be able to tell you so.

You remain solely and entirely responsible for your own decisions, your own performance, and your own safety. Nothing the App does or fails to do transfers any part of that responsibility.

4. Safety

Do not interact with the App while doing anything that requires your attention. Do not perform a breathing exercise while driving, operating machinery, at height, in water, or anywhere a change in your breathing or a moment of divided attention could cause harm. "Continue Session" exists so that you can dismiss an alert instantly and without cost.

If any breathing exercise causes dizziness, discomfort, or distress, stop immediately. If you have a cardiac, respiratory, or psychiatric condition, or are pregnant, speak with your clinician before using breathing exercises.

5. Your data

Vigil stores your session data on your device. See the Privacy Policy. You are responsible for the security of your device.

6. Acceptable use

Do not reverse-engineer or decompile the App. Do not use it in any safety-critical, life-support, or automated decision-making system. Do not represent its output as clinical data.

7. No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE, OR THAT IT WILL DETECT ANY PARTICULAR PHYSIOLOGICAL STATE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP — INCLUDING ANY DECISION YOU MAKE OR DO NOT MAKE ON THE BASIS OF, OR IN THE ABSENCE OF, AN ALERT.

Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent permitted.

9. Changes

We may update these terms. Material changes will be notified in-app or through the App Store listing.

10. Termination

You may terminate at any time by deleting the App.
